Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Get Positioned ("we", "us") governing your use of the AORKA app and related services (the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

AORKA is an AI operating layer that helps founders prioritise decisions, run an AI boardroom, plan execution and maintain a Business Brain. Outputs are generated by AI models and are provided as recommendations for your consideration — they are not professional legal, financial, tax, medical or investment advice.

2. Your account

• You must be at least 16 years old (or 18 where required in your jurisdiction) and able to enter a binding contract.
• You are responsible for your credentials and everything done under your account.
• You must provide accurate information and keep it current.

3. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right.
• Upload content that is unlawful, infringing, or that you do not have the right to submit.
• Attempt to reverse-engineer, resell, scrape or overload the Service.
• Use the Service to build a competing product or to train a competing model.
• Submit sensitive categories of data (e.g. health, government IDs, payment card data outside our billing flow) unless we've agreed otherwise in writing.

4. Your content

You keep all rights to the content you submit ("Customer Content"). You grant us a limited licence to host, process and display it only as needed to run the Service for you. We do not use Customer Content to train foundation models.

5. Fees & billing

• Paid plans renew automatically until cancelled.
• Fees are non-refundable except where required by law.
• We may change pricing on 30 days' notice; changes apply to your next billing cycle.
• You are responsible for any applicable taxes.

6. AI outputs

AI-generated content can be inaccurate, incomplete or biased. You are responsible for reviewing outputs before acting on them. To the extent permitted by law, we make no warranty that AI outputs are correct, suitable for your business, or free of infringement.

7. Third-party services

The Service integrates with third-party providers (e.g. AI model providers, payment processors, email delivery). Your use of those services is subject to their own terms.

8. Termination

You can cancel at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms or if required by law. On termination you may export your Customer Content for 30 days, after which we may delete it.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) US$100. We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example, for death or personal injury caused by our negligence, or for fraud).

11. Indemnity

You will defend and indemnify us against third-party claims arising from your Customer Content or your breach of these Terms, except to the extent caused by our own negligence or wilful misconduct.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Get Positioned is established, without regard to conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over any dispute, except where mandatory consumer law grants you additional rights.

13. Changes

We may update these Terms from time to time. If a change is material we'll give you at least 14 days' notice. Continued use of the Service after the effective date means you accept the updated Terms.
